Introduction
This website is owned and operated by Eat Rite With Lulu Limited, trading as "Eat Rite With Lulu".
Please read these terms and conditions carefully. They apply when you subscribe to any meal plans or purchase any meals via this website or our mobile application (our ‘Platforms’). Please print or save these terms for future use as we will not keep a file copy specifically for the transaction with you and we cannot guarantee that they will remain accessible on our website in future. These terms and conditions are available in the English language only.
By using our Platforms in any manner, you confirm that you accept these terms of use and that you agree to comply with and be bound by them.
Where we refer to "Consumer" below we mean an individual acting for purposes which are wholly or mainly outside that person's trade, business, craft or profession.
We are legally required to remind Consumers that we are under a legal duty to supply meal plans and meals that are in conformity with the contract. Furthermore, nothing below affects Consumers' legal rights in relation to meal plans and meals that are not in conformity with the contract, whether because they are faulty, not as described or otherwise.
We may change these terms and conditions at any time by posting a new version on our site. Please check them carefully as they will apply to any existing subscriptions, recurring deliveries or new orders occurring after the effective date shown.
1.0 Our Services
Eat Rite With Lulu offers tailored meal plan subscriptions and meal delivery services to consumers. Our services include:
- Design and delivery of prepared meals according to our meal catalogue and subscription schedule.
- Custom meal plans designed to individual nutritional requirements and preferences.
- Customization options for special dietary requests.
- Ability to modify or pause subscriptions.
1.1 Nutritional Information
While we strive for accuracy in our nutritional information, we do not guarantee the precise nutritional content of meals. Variations may occur due to natural differences in ingredients, preparation methods, and portion sizes.
1.2 Allergies and Dietary Restrictions
During registration, consumers are required to disclose any allergies or dietary restrictions. While we take reasonable precautions to accommodate special requests, all meals are prepared in shared kitchen facilities where cross-contamination with allergens such as nuts, gluten, dairy, eggs, soy, fish, shellfish, and other known allergens may occur despite our best efforts. We cannot guarantee that meals are completely free from traces of allergens.
Individuals with severe or life-threatening allergies should be aware of these risks before ordering. For severe allergies, we strongly recommend consulting with your healthcare provider before subscribing to our meal service.
Eat Rite With Lulu reserves the right to make ingredient substitutions when necessary, which may affect the allergen content of meals. While we strive to communicate such changes, we cannot guarantee notification of all substitutions.
Eat Rite With Lulu will not be held liable for any allergic reaction or health complications arising from consuming our meals, including but not limited to situations where:
- Allergies or dietary restrictions were not fully disclosed during registration;
- Disclosed allergies were affected by potential cross-contamination despite our reasonable precautions;
- Ingredient substitutions were made due to supply chain or quality issues; or
- The consumer continued to consume meals after experiencing initial sensitivity.
By ordering from Eat Rite With Lulu, consumers acknowledge and accept these risks.
1.3 Health Claims
Our meal plans are not intended to diagnose, treat, cure, or prevent any disease or health condition. Any nutritional recommendations are not substitutes for professional medical advice.
1.4 Meal Freshness Guarantee
Eat Rite With Lulu guarantees that, when properly refrigerated at or below 40°F (4°C), our prepared meals will remain fresh and safe for consumption for up to 5 days from the delivery date. To maintain freshness, customers must refrigerate meals promptly upon delivery.
This guarantee does not cover:
- Meals improperly stored or exposed to temperatures above 40°F (4°C)
- Meals that have exceeded the 5-day freshness period
- Changes in texture or appearance that do not affect food safety
- Opened or partially consumed meals
1.5 Quality Assurance
All meals are prepared according to strict food safety protocols in our kitchen facilities to ensure maximum freshness and quality upon delivery.
2.0 Membership and Registration
2.1 Our Services are available only to and may only be used by individuals who are 18 years and older and who can form legally binding contracts under applicable law. You represent that you are at least 18 years old and that all registration information you submit is accurate and truthful.
2.2 Users who fulfill the requirements above must create an account in accordance with clause 2.3 below.
2.3 In order to create an account, you must provide a full name, email address, telephone number, age, delivery address, allergies (if any)/special dietary requirements, goals. It is at this point that you are required to tick a box to confirm to agree with our terms of use and privacy policy.
2.4 You are solely responsible for keeping your login details confidential and must not disclose or share it with anyone. You will be responsible for all activities and orders that take place using your login information. In the event of theft, loss or unauthorised use of a User’s password or account, you must contact us immediately at eatritewithlulu@gmail.com
2.5 As a user, you:
- represent and understand that all account information provided is accurate, up-to-date, honest and not misleading;
- commit to updating your account information as and when it changes; and
- accept sole responsibility for any direct or indirect adverse consequences caused by the inaccuracy of this information or failure to update this information.
3.0 Payments
3.1 Payment Methods
Payments for orders, can be made in two ways:
- via an authorized third-party payment processor which provides a gateway for online payments.
- via direct bank transfer to our designated bank account.
3.2 Third-Party Payment Processing:
- When you choose to pay via our third-party payment processor, your payment information is collected and processed directly by the processor.
- We do not store your complete payment card details on our servers.
- Your use of the third-party payment service is subject to that processor's terms and conditions and privacy policy, which we encourage you to review.
- Eat Rite With Lulu is not responsible for errors, failures, or disruptions in the third-party payment processing service.
3.3 Bank Transfers
- When opting for bank transfer, you must use the specific account details provided during checkout.
- Your subscription or order will only be processed after payment confirmation is received.
- You are responsible for any transfer fees charged by your bank.
- Please include your order reference number in the transfer description to ensure proper allocation of your payment.
3.4 Payment Timing
- For subscriptions, payment is processed in advance of the subscription period.
- For one-time orders, full payment is required before order processing begins.
- Recurring subscription payments will be automatically charged according to your selected billing cycle.
3.5 Payment Security
- We implement reasonable security measures to protect payment information.
- However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
3.6 Failed Payments
- Failed or declined payments may result in subscription pause or cancellation.
- We reserve the right to attempt to process the payment again and/or contact you for alternative payment arrangements.
4.0 Delivery
4.1 Third-Party Delivery Services
- We partner with independent third-party delivery providers to fulfill meal deliveries.
- By placing an order, you acknowledge and agree that delivery services are performed by independent contractors who are not employees of Eat Rite With Lulu.
- While we carefully select our delivery partners, we cannot directly control their operations or delivery personnel.
4.2 Delivery Areas and Windows
- Delivery is available only within our designated service areas, which may change from time to time.
- Deliveries occur within specified time windows rather than at exact times.
- We will communicate the expected delivery date and approximate time window prior to each delivery.
- Delivery schedules may vary based on location, weather conditions, and delivery partner availability.
4.3 Delivery Instructions and Access
- You are responsible for providing accurate delivery address and contact information.
- Special delivery instructions must be provided at the time of order placement or at least 24 hours before scheduled delivery.
- You must ensure safe and reasonable access to the delivery location.
- If special access (estate or building codes, gate passes, etc.) is required, this information must be provided in advance.
4.4 Failed or Missed Deliveries
- If you are not present to receive delivery, you should provide information of an alternative person authorized to accept delivery on your behalf. This alternative contact information must be provided in advance.
- For food safety reasons, we cannot be responsible for meals left unrefrigerated for extended periods after delivery attempt.
- If a delivery cannot be completed due to incorrect address information, access issues, or other customer-caused reasons, you may be charged a redelivery fee.
- Eat Rite With Lulu reserves the right to charge the full meal cost for deliveries that cannot be completed due to customer error.
4.5 Delivery Delays and Issues
- While we strive for timely deliveries, delays may occur due to traffic, weather conditions, or other circumstances beyond our reasonable control.
- In case of significant delays, we will attempt to notify you via your provided contact information.
- Complaints regarding delivery service should be reported to us within 24 hours of the scheduled delivery.
4.6 Liability Limitation
- Eat Rite With Lulu's liability related to delivery issues is limited to the value of the affected meals.
- We are not liable for consequential damages resulting from late or missed deliveries.
- In the event of delivery issues caused by the third-party delivery service, our responsibility is limited to reasonable assistance in resolving the matter with our delivery partner.
5. Force Majeure
Eat Rite With Lulu is not responsible for delivery delays or failures due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, public emergencies, strikes, riots, war, pandemic restrictions, or other force majeure events.
6. Risk and ownership
Risk of damage or loss to the goods passes to you on delivery to you or to somebody identified by you to take possession of the goods.
7.0 Subscription Cancellations and Pauses
7.1 Cancellations
When you cancel your subscription, you cancel only future charges associated with your subscription. You may initiate your cancellation at any time, but the cancellation will become effective at the end of your current subscription period.
EXCEPT AS OTHERWISE STATED HEREIN OR REQUIRED BY APPLICABLE LAW, YOUR SUBSCRIPTION FEE IS NONREFUNDABLE and if you cancel your subscription, you will not receive a refund, but you can continue to enjoy our meals and your benefits through the end of your then-current subscription period.
7.2 Pausing Subscriptions
Customers may temporarily pause their subscription for up to 4 consecutive weeks.
Paused subscriptions will not be charged during the pause period.
To pause a subscription, customers must log into their account or contact customer service.
To resume a paused subscription, customers must log into their account or contact customer service at least 3 business days before their desired resumption date.
Subscriptions paused for longer than 4 consecutive weeks will be automatically cancelled, with notice provided to the subscriber.
7.3 Eat Rite With Lulu-Initiated Cancellations:
Eat Rite With Lulu reserves the right to cancel or suspend any subscription at our discretion for reasons including but not limited to:
- Repeated failed payments
- Abusive behavior toward staff or delivery personnel
- Suspected fraudulent activity
- Violation of our Terms and Conditions
When possible, we will provide notice before cancellation, but immediate cancellation may occur in cases of policy violations or fraud.
8. Updates and Changes
Eat Rite With Lulu does not represent or warrant that particular subscription benefits or features will be offered indefinitely and reserves the right to, in its sole discretion, change the fees or alter the features and benefits associated with a meal plan subscription. If we change the weekly, or monthly charged for a subscription, we will notify you and provide you with the opportunity to cancel your subscription before your meal plan subscription is renewed for another subscription term. If you do not wish to continue subscribing with the new subscription fees, you may cancel your subscription within the specified notice period. We may also notify you of meal plan feature changes, including but not limited to changes in menu options, delivery areas, or customization options.
Your continued use of our service after a fee or feature change becomes effective will constitute your acceptance of the change, and any updated terms and conditions will apply for the remaining subscription term and all renewals going forward.
9. No Transfer or Assignments and Cancellations by Eat Rite With Lulu
Your meal plan subscription cannot be transferred or assigned to another person or address without prior approval from Eat Rite With Lulu. We reserve the right to accept, refuse, suspend, or cancel your subscription at any time in its sole discretion. If we cancel your subscription, you will receive a refund of your subscription fee on a prorated basis based on the amount of time remaining in your pre-paid subscription period and any undelivered meals, unless Eat Rite With Lulu terminates your account or your subscription because it determines, in its sole discretion, that your actions or your use of the Eat Rite With Lulu service violates this Agreement, has harmed delivery personnel, has resulted in excessive complaints, or has involved fraudulent activity.
10. DISCLAIMER
The services are provided "As Is" and "As Available". Eat Rite With Lulu disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms. Eat Rite With Lulu makes no representation, warranty, or guarantee that the Services will be uninterrupted or error-free. You agree that the entire risk arising out of your use of the Services, and any meal plan requested in connection with it, remains solely with you, to the maximum extent permitted under applicable law.
Eat Rite With Lulu further disclaims any responsibility for medical or nutritional outcomes. We are not medical practitioners, dietitians, or licensed nutritionists, and our Services are strictly limited to the preparation and delivery of meal plans. We do not provide medical advice, offer diagnoses, treat medical conditions, or provide any form of healthcare services.
While our meal plans may be designed with general nutritional principles in mind, they are not intended to treat, cure, or prevent any disease or medical condition. Customers with specific health concerns, medical conditions, or dietary requirements should consult with qualified healthcare professionals before subscribing to our meal plans.
Eat Rite With Lulu does not guarantee weight loss, improvement in athletic performance, or any specific health outcomes as a result of consuming our meals. Individual results may vary based on numerous factors beyond our control.
11. Governing Law
These terms of use are governed by Nigerian law. In the event of a dispute regarding the validity, interpretation and/or execution of these terms, the parties submit to the exclusive jurisdiction of the Nigerian courts.
